Welcome to Hype Shoppe!

The terms "we," "us," and "our" refer to Hype Shoppe. Hype Shoppe operates this website and online store, including all related information, content, features, tools, products, and services provided to you (collectively, the "Services").

Hype Shoppe is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service ("Terms") describe your rights and responsibilities when accessing or using our Services.

Please read these Terms carefully. They contain important information regarding your legal rights, including warranty disclaimers and limitations of liability.

By visiting, interacting with, purchasing from, or otherwise using our Services, you agree to be bound by these Terms, our Privacy Policy, Refund Policy, and Shipping Policy.

If you do not agree with these Terms or our policies, you should not access or use our Services.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your state or jurisdiction of residence, or that you are the age of majority and have given permission for any minor dependents to use the Services on devices you own or manage.

To access certain portions of the Services or make a purchase, you may be asked to provide information including your name, email address, billing information, payment information, and shipping address.

You represent and warrant that all information you provide is accurate, current, and complete.

You are responsible for maintaining the confidentiality and security of your account credentials and for all activity conducted through your account.

You may not transfer, sell, assign, or license your account to another person.

SECTION 2 - OUR PRODUCTS

We make reasonable efforts to accurately display and describe the products available through our store.

However, product colors, appearance, packaging, dimensions, or other characteristics may appear differently depending on your device, screen settings, manufacturing variations, or updates made by the manufacturer or supplier.

Product photographs are provided for illustrative purposes. Minor differences in color, packaging, branding, labeling, or appearance that do not materially affect the function of a product may occur.

We do not guarantee that the appearance of a product will be identical to the way it appears on your screen.

All product descriptions, pricing, availability, specifications, and other product information may be changed at any time without notice.

We reserve the right to discontinue products or limit quantities available to any person, household, geographic region, or jurisdiction.

Third-Party Fulfillment

Some products offered by Hype Shoppe are stored, packaged, and shipped directly to customers by third-party suppliers and fulfillment partners.

These fulfillment partners may be located within or outside the United States, including in China and other international locations.

As a result, individual products within the same order may:

Ship from different locations
Arrive in separate packages
Have different tracking numbers
Arrive on different dates

Use of third-party fulfillment does not change your relationship with Hype Shoppe. Your purchase is made from Hype Shoppe, and questions regarding your order should be directed to us rather than to the fulfillment provider.

SECTION 3 - ORDERS

When you submit an order, you are making an offer to purchase the products contained in that order.

Hype Shoppe reserves the right to accept, decline, limit, or cancel an order for legitimate business reasons, including suspected fraud, payment issues, product availability, pricing errors, shipping restrictions, or inventory issues.

An automated order confirmation does not necessarily constitute final acceptance of your order.

Payment must be authorized and processed before an order can be fulfilled.

Please review your order carefully before submitting it.

Because orders may be transmitted to our fulfillment partners shortly after purchase, we cannot guarantee that an order can be modified or canceled after it has been placed.

If you need to cancel or modify an order, contact us as soon as possible.

If your order has already entered fulfillment or has shipped, it may need to be handled according to our Refund & Return Policy.

All purchases are subject to our Refund & Return Policy.

We reserve the right to limit or prohibit orders that we reasonably believe are being placed by dealers, resellers, distributors, fraudulent purchasers, or other parties purchasing products for unauthorized commercial resale.

SECTION 4 - PRICES, BILLING, AND PAYMENT

Prices, discounts, promotions, and product availability are subject to change without notice.

The price charged for a product will generally be the price displayed at the time your order is submitted, subject to correction of obvious pricing or technical errors.

Applicable shipping charges, taxes, and other charges will be displayed during checkout where required.

You agree to provide current, complete, and accurate purchase, billing, payment, and account information.

You represent and warrant that:

The payment information you provide is accurate;
You are authorized to use the payment method provided;
Charges incurred by you will be honored by your payment provider; and
You will pay all charges associated with your order.

If we discover an obvious pricing, product-description, or system error after an order has been placed, we reserve the right to contact you to correct the error or cancel and refund the affected order.

SECTION 5 - SHIPPING AND DELIVERY

Our current processing times, estimated delivery times, shipping methods, tracking information, and other shipping terms are described in our Shipping Policy.

Because some products are shipped from international fulfillment centers, delivery may take longer than traditional domestic retail shipping.

Delivery dates are estimates and are not guaranteed.

Orders may be delayed by circumstances including:

Carrier delays
Customs processing
Weather
Holidays
Transportation disruptions
High shipping volumes
Supplier processing delays
Incorrect or incomplete shipping addresses
Events outside our reasonable control

If we become aware that we cannot ship your order within the timeframe promised or otherwise required by applicable law, we will provide any notice, cancellation option, or refund required by applicable law.

Customers are responsible for providing complete and accurate shipping information.

If you notice an error in your shipping information, contact us immediately. We will attempt to correct the information before fulfillment but cannot guarantee changes once an order has entered fulfillment.

Risk of loss and ownership of purchased products will transfer in accordance with applicable law. Nothing in these Terms is intended to waive consumer rights that cannot legally be waived.

SECTION 6 - RETURNS, REFUNDS, AND EXCHANGES

Returns, refunds, replacements, exchanges, damaged products, defective products, lost shipments, and incorrect items are governed by our Refund & Return Policy.

Customers should contact us before returning a product.

Do not automatically return a product to the address appearing on the original shipping label or packaging. The return address may be different from the location from which the product was originally shipped.

Unauthorized returns may not be accepted.

Nothing in our Refund & Return Policy or these Terms limits any consumer right that cannot legally be waived.

SECTION 7 - INTELLECTUAL PROPERTY

The Services, including trademarks, branding, text, graphics, images, logos, videos, audio, website design, and other content, are owned by Hype Shoppe, its affiliates, licensors, suppliers, or other applicable rights holders and are protected by applicable intellectual property laws.

These Terms permit you to use the Services for personal, non-commercial purposes.

Except as expressly permitted, you may not reproduce, distribute, modify, create derivative works from, publicly display, publish, republish, download, store, sell, or transmit materials from the Services without permission from the applicable rights holder.

Nothing contained in these Terms grants you ownership of any trademark, copyright, patent, or other intellectual property belonging to Hype Shoppe, Shopify, our suppliers, manufacturers, licensors, or third parties.

Shopify's name, logos, product names, and related marks belong to Shopify or its applicable affiliates.

All other trademarks are the property of their respective owners.

SECTION 8 - OPTIONAL TOOLS

We may provide access to tools, applications, or functionality operated by third parties that we do not control.

Access to third-party tools may be provided "as is" and "as available" without warranties, representations, or endorsements by us.

Your use of third-party tools is at your own risk and discretion and may also be governed by the applicable third party's terms and privacy policies.

We may introduce additional features, tools, services, or resources in the future. Such features will also form part of the Services and may be subject to these Terms.

SECTION 9 - THIRD-PARTY LINKS AND SERVICES

The Services may contain links, integrations, content, or functionality provided by third parties.

We are not responsible for examining or evaluating the accuracy, security, availability, content, policies, or practices of third-party websites or services.

If you leave our Services to access a third-party website or service, you do so at your own discretion.

SECTION 10 - RELATIONSHIP WITH SHOPIFY

Hype Shoppe is powered by Shopify, which enables us to provide the Services to you.

However, any sales and purchases you make through our Store are made directly with Hype Shoppe.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales between you and Hype Shoppe, including any injury, damage, or loss resulting from purchased products or services.

To the fullest extent permitted by applicable law, you release Shopify and its affiliates from claims, damages, and liabilities arising from or related to purchases and transactions made with Hype Shoppe.

SECTION 11 - PRIVACY

Personal information collected through the Services is handled according to our Privacy Policy.

Because our Services are hosted by Shopify, Shopify also collects and processes certain information relating to your access to and use of the Services.

Information submitted through the Services may be transmitted to Shopify and other service providers located in the United States or other countries in order to process payments, fulfill orders, provide customer support, prevent fraud, operate our store, or provide other services.

SECTION 12 - CUSTOMER FEEDBACK, REVIEWS, AND SUBMISSIONS

If you submit reviews, photographs, videos, comments, ideas, suggestions, feedback, or other content ("Feedback"), you grant Hype Shoppe a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, publish, distribute, display, and otherwise use that Feedback in connection with operating and promoting our business and Services, subject to applicable law.

You represent that you own or have permission to submit the Feedback and that its use will not violate the rights of another person.

You may not submit content that is unlawful, defamatory, threatening, obscene, fraudulent, infringing, malicious, or otherwise prohibited by these Terms.

You may not falsely represent yourself as another person or misrepresent the origin of Feedback.

You remain responsible for the accuracy and legality of content you submit.

We reserve the right, but are not obligated, to monitor or remove Feedback where permitted by law.

SECTION 13 - ERRORS, INACCURACIES, AND OMISSIONS

Occasionally, information on the Services may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, delivery estimates, availability, specifications, or other information.

We reserve the right to correct errors or update information where permitted by law.

If an error materially affects an order you have already placed, we may contact you regarding the correction or cancel and refund the affected order where appropriate.

You may use the Services only for lawful purposes.

You may not use the Services:

For unlawful, fraudulent, or malicious activity;

If you use automated or semi-automated software, artificial intelligence agents, bots, or similar systems ("Agents") to access or interact with the Services, those Agents must comply with applicable access restrictions, security measures, and instructions provided through the Services.

Agents may not conceal their automated nature, circumvent CAPTCHAs or security controls, impersonate human users, interfere with the Services, or evade measures intended to restrict automated access.

We may restrict, limit, or block automated access where permitted by law.

SECTION 16 - TERMINATION

We may suspend or terminate access to the Services where permitted by law, including when we reasonably determine that these Terms have been violated.

Termination does not eliminate obligations or liabilities incurred before termination.

Provisions that by their nature are intended to survive termination—including intellectual property, limitation of liability, indemnification, governing law, and related provisions—will continue to apply.

SECTION 17 - DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

EXCEPT AS EXPRESSLY PROVIDED BY HYPE SHOPPE OR REQUIRED BY APPLICABLE LAW, WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND REGARDING THE SERVICES.

WE DO NOT GUARANTEE THAT THE SERVICES WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, SECURE, OR ERROR-FREE.

CERTAIN JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES. IN THOSE JURISDICTIONS, THE ABOVE LIMITATIONS APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Nothing in this section eliminates warranties or consumer protections that cannot legally be excluded.

SECTION 18 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HYPE SHOPPE AND ITS AFFILIATES, PARTNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING FROM OR RELATING TO YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THE SERVICES.

THIS MAY INCLUDE LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR SIMILAR DAMAGES WHERE SUCH LIMITATIONS ARE PERMITTED BY LAW.

THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

SECTION 19 - INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless Hype Shoppe and our affiliates, partners, officers, directors, employees, contractors, agents, licensors, and service providers from third-party claims, liabilities, losses, damages, and reasonable expenses arising from:

Your material breach of these Terms;
Your violation of applicable law;
Your infringement of the rights of another person; or
Your unlawful or unauthorized use of the Services.

SECTION 20 - SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law and the unenforceable portion will be severed.

The remaining provisions will continue in full force and effect.

SECTION 21 - WAIVER AND ENTIRE AGREEMENT

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

These Terms, together with our Privacy Policy, Shipping Policy, Refund & Return Policy, and other policies posted through the Services, constitute the agreement between you and Hype Shoppe regarding use of the Services.

SECTION 22 - ASSIGNMENT

You may not transfer or assign your rights or obligations under these Terms without our prior written consent where such restriction is permitted by law.

We may assign or transfer our rights and obligations in connection with a merger, acquisition, sale, restructuring, or other transfer of our business, subject to applicable law.

SECTION 23 - GOVERNING LAW

These Terms and any separate agreements relating to the Services will be governed by the laws applicable in the jurisdiction where Hype Shoppe is headquartered, without limiting any mandatory consumer protections that apply to you under the laws of your jurisdiction.

Any dispute regarding these Terms will be handled in courts having appropriate jurisdiction, subject to applicable law.
